Supreme Court: Property flooding caused by government requires compensation

Property owners won a victory Tuesday in the U.S. Supreme Court, which ruled that temporary flooding caused by government actions constitutes a "taking" of land that requires compensation, The Business Journals reported.

The court ruled 8-0 in favor of the Arkansas Game & Fish Commission, which sued the federal government over flood damage to a state forest that occurred when the U.S. Army Corps of Engineers released extra water from a dam in southeast Missouri to help farmers.
